A work permit is an indispensable document for a foreign laborer who wants to work legally in Vietnam. In case it is lost, damaged by accident, or updated with new information, foreigners toned to get their work permit reissued as soon as possible.
1. Requirements to replace a lost work permit
It is stated under Article 12 of Decree No.152/2020/ND-CP that foreign workers can request a work permit reissuance in the following cases:
• The valid work permit is lost
• The valid work permit is damaged
• The contents stated in the issued work permit are changed (nationality, passport number, work address)
2. Work permit reissuance procedures
Step 1: Reissuance report
03 days since the foreign employees have found out that their work permits were lost, damaged or the documents needed to be updated with new information, such as full name, date of birth, nationality, passport number and so on; the employers should be informed by their foreign staff
Step 2: Submitting documents for a re-issued work permit
5 days after receiving the report from employees, employers have to submit the regranted-work-permit applications to the local Department of Labor which has the authority to reissue work permits for foreign/overseas employees.
Step 3: New work permits granted
If the worker's dossier is valid, the Ministry of Labor, War Invalids and Social Affairs or Labor Department will grant them a new work permit within 3 working days. In contrast, they will provide the reasons for the rejection in case they do not accept the dossier of reissued work permit.
3. Required documents to apply for reissuance of work permit
Employers need to prepare these following documents:
• A request for work permits reissuance (according to the form No.11/PL1 in Appendix I issued enclosed with Decree 152/2020/ND-CP)
• 02 colored photos (4cm x 6cm, white background, full and clear face, taken within 6 months till the application date)
• A valid work permit (an original or a certified copy if the original was lost or damaged)
• In case of losing work permit, employees need a proposal for reissuance of work permit made by the local authority or their employers
• In case of changing contents stated in the work permit, employees need to prepare some evident documents for proving that change.
• An approval to employ foreign foreigners, unless the business is exempt from obtaining approval.
Vietnamese reissued work permit validity and processing time
Processing time is 03 working days from the submission date.
A reissued work permit’s validity is equal to the term of work permit.
