Vietnam is a developing country with many attractive job opportunities for foreigners. However, in order to work legally in Vietnam, foreigners need to have a work permit. In this case, the sponsorship of an organization or individual in Vietnam is required.

 

Who Can Sponsor Foreigners to Work in Vietnam?

According to Vietnamese law, the following organizations and individuals can sponsor foreigners to work in Vietnam:

  • Enterprises, cooperatives, economic organizations with foreign investment, foreign non-governmental organizations, international organizations, foreign organizations and individuals with the function of cultural, educational, scientific, technological, medical, sports, tourism, and other services in Vietnam.

  • Foreign agencies, organizations, and individuals with headquarters or places of operation in Vietnam.

  • State agencies, political organizations, political-social organizations, socio-professional organizations, social organizations, social funds, and charitable funds of Vietnam.

  • Vietnamese citizens residing in the country.

 

Conditions for Sponsoring Foreigners to Work in Vietnam

In order to sponsor foreigners to work in Vietnam, the sponsoring organization or individual must meet the following conditions:

  • Have legal personality or an individual recognized by Vietnamese law.

  • Have the financial ability to ensure the cost of living and work for foreigners during the sponsorship period.

  • Have a need to use foreign labor.

 

Documents for Sponsoring Foreigners to Work in Vietnam

The documents for sponsoring foreigners to work in Vietnam include the following:

  • Application for sponsorship for foreigners to work in Vietnam.

  • A copy of the business license or operating license of the sponsoring organization or individual.

  • A copy of the identity card or citizen identity card of the legal representative of the sponsoring organization or a copy of the passport and visa of the individual sponsor.

  • A copy of the work permit, practice license, or certificate of practice of the foreigner.

  • A copy of the employment contract or service contract between the foreigner and the sponsoring organization or individual.

 

Procedure for Sponsoring Foreigners to Work in Vietnam

The procedure for sponsoring foreigners to work in Vietnam is as follows:

  • The sponsoring organization or individual submits the sponsorship dossier to the Immigration Administration Department or the Immigration Department of the province, centrally-affiliated city where the headquarters or place of operation of the sponsoring organization or individual is located.

  • Within 10 working days from the date of receiving the complete and valid dossier, the Immigration Administration Department or the Immigration Department of the province, centrally-affiliated city considers and issues a work permit for the foreigner.

 

Rights and Obligations of Foreigners Sponsored

Foreigners sponsored to work in Vietnam have the following rights and obligations:

  • The right to work according to the work permit that has been granted.

  • The right to be legally protected in terms of life, health, honor, dignity, and property.

  • The right to enjoy the benefits of social insurance, health insurance, and unemployment insurance in accordance with Vietnamese law.

  • The obligation to comply with Vietnamese law, the regulations of the sponsoring organization or individual.

  • The obligation to pay social insurance and health insurance in accordance with Vietnamese law.

  • The obligation to pay taxes in accordance with Vietnamese law.

 

Sponsorship for foreigners to work in Vietnam is an important procedure that allows foreigners to work legally in Vietnam. In order to sponsor successfully, the sponsoring organization or individual must prepare the complete dossier and meet the conditions stipulated by law.
